Cloud Services/Software (AI) Acceptable Use Policy

Effective Date: June 5, 2024

1. Purpose. This Acceptable Use Policy (“AUP”) outlines the acceptable and responsible use of NiCE Cloud Services and Software with AI technology or features (collectively, the “AI Service(s)”). By use of the AI Services, all Customers, including Customer personnel, agree to the terms of this AUP.

2. Definition of AI in the AI Services. For the purposes of this AUP, “AI” means artificial intelligence, including natural language processing, machine learning, predictive analytics, and generative artificial intelligence.

3. Ethical Guidelines. Customers must adhere to ethical principles when using AI features, promoting fairness, transparency, and accountability. Discriminatory, biased, or unethical practices in AI interactions are strictly prohibited.

4. Compliance with Laws and Regulations. Customers must comply with all applicable laws, regulations, and industry standards governing the use of AI in the AI Services in the jurisdiction where they operate. The AI Services must not be used for any purpose that violates local, national, or international laws.

5. Data Privacy and Security. Customers are responsible for ensuring the protection of personal and sensitive data processed by the AI Services. The AI Services must be used in accordance with the data privacy and security provisions outlined in the privacy policy associated with the AI Services.

6. User Consent and Notification. Customers are responsible for making legally adequate disclosures and privacy notices to, and obtaining appropriate consents from, individuals whose data is to be processed by an AI Service.

7. Prohibited Uses. Use of the AI Services for any of the following is strictly prohibited: (a) discriminatory or harmful purposes; (b) illegal, fraudulent, or malicious activities; (c) violation of intellectual property rights; (d) distribution of false or misleading information; and (e) any use that disrupts the normal operation of the AI Services.

8. Monitoring and Compliance. Customer’s use of the AI Services may be monitored to ensure compliance with this AUP. Customers found in violation of the AUP may face suspension or termination of access to the AI Services.

9. Stakeholder Engagement. NiCE encourages engagement with Customers to gather feedback and address concerns related to AI usage. Continuous improvement is essential for responsible AI development and deployment.

10. Review and Update. This AUP will be periodically reviewed and updated to reflect changes in technology, legal requirements, and ethical standards.

11. Third-Party Providers. If third-party AI services are integrated into the AI Services, Customers must comply with the acceptable use policies required by such third-party providers.
